A BILL to amend article fourteen, chapter thirty-seven of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended, be amended by adding thereto a new section,
designated section four-a, relating to further exceptions to
license or certification requirement.
Be it enacted by the Legislature of West Virginia:
That article fourteen, chapter thirty-seven of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
four-a, to read as follows:
ARTICLE 14. THE REAL ESTATE APPRAISER LICENSING AND
CERTIFICATION ACT.
§37-14-4a. Further exceptions to license or certification
requirement.
tothwithstanding any other provision of this article,
beginning the first day of July, one thousand nine hundred
ninety-four, the following exception to the license orcertification requirement applies:
Any person who, for compensation or valuable consideration,
prepared a valuation appraisal or a valuation appraisal report
relating to real estate or real property in this state between
the first day of July, one thousand nine hundred eighty-seven and
the first day of July, one thousand nine hundred ninety-one,
shall be considered certified as a state certified residential
real estate appraiser, as defined by subsection (b), section
twenty-eight of this article: Provided, That the person presents
satisfactory evidence to the board that he or she prepared such
valuation appraisal or valuation appraisal report.
Upon such approval of the board of the evidence presented,
the board shall issue a certificate that will expire one year
following the date of the issuance, in accordance with section
thirteen of this article to the person, certifying that person as
a state certified residential real estate appraiser.
As a state certified residential real estate appraiser, all
other provisions of this article which would apply to certified
residential real estate appraisers who passed the examination
required by section thirty-one of this article apply to the
persons qualifying as a state certified residential real estate
appraiser under this section, including, but not limited to, the
continuing education requirements set out in sections fourteen
and thirty-six of this article.
NOTE: The purpose of this bill is to provide persons withthe experience of conducting real estate appraisals prior to July
1, 1991, an opportunity to continue conducting an intermediate
level of real estate appraisals without being required to qualify
to take and pass the appraisers' examination. The purpose of
requiring the experience to be between July 1, 1987 and July 1,
1991, is to ensure that the person conducted an up-to-date real
estate appraisal and not a simple market analysis.
§37-14-4a is new; therefore, strike-throughs and
underscoring have been omitted.
